Eligibility

To be eligible for the Waterloo Region Bail Program and Bail Supervision, an accused person must:

​

  • Be a youth aged 12–15, or an adult aged 16 or older

​

  • Currently be in custody awaiting a bail hearing

​

  • Be willing to participate in and be amenable to the conditions of release

​

  • Be unable to meet the requirements of a monetary condition, viable surety and or adequate housing

​

  • Require a surety but does not have one that is appropriate or they have withdrawn

Referrals

To be referred to the Waterloo Region Bail Program, the following process is in place:



  • The Crown, defence lawyer or duty counsel will assess the mandatory criteria above. If the criteria are met, the Bail Supervisor will interview the accused to determine whether they qualify for the program.

  • The Bail Supervisor will verify that the accused does not have an appropriate surety, monetary deposit and/or stable residence.

  • The Bail Supervisor will submit a Bail Verification Report to the Crown and defence lawyer or duty counsel, indicating if the program is an option for the accused.

​

  • The Crown, defence lawyer or duty counsel will provide the information to the court and the court will decide if the accused will be released under supervision of the Waterloo Region Bail Program.

 

An accused may be denied access to the Waterloo Region Bail Program if:

​

  • A suitable surety is found

​

  • A viable Bail supervision plan can not be determined.
